DEFINITIONS AND INTERPRETATION
‘ATG’ (and ‘We’, ‘Our’, ‘Ours’ and ‘Us’) refers to ATG Entertainment Limited, registered in England and Wales with company number 2671052 whose registered office is at 2nd Floor, Alexander House, Church Path, Woking, GU21 6EJ who is the Trader for the purposes of The Consumer Rights Act 2015.
‘Event’ means an entertainment event including, without limitation, a concert, exhibition, sport, theatrical and/or music event to be held at a Venue in respect of which We have the right to sell You Tickets.
‘Site’ means www.atgtickets.com
‘Terms and Conditions’ means these terms and conditions.
‘Tickets’ means printed, electronic or other type of evidence (including a wristband) of the right to occupy space at or to attend an Event sold by Us to You on behalf of the Event Partner(s).
‘Venue’ means any facilities or locations of any nature where the Event is being held.
‘Voucher(s)’ means an ATG Gift Voucher You purchase from Us.
‘Working Day’ means Monday to Friday, excluding any Public or Bank Holidays.
‘You’ means you as the purchaser of a Voucher or anybody who in Our reasonable opinion is acting with your authority or permission. ‘Your’ shall be read accordingly.
‘Recipient’ is the person to whom the Voucher has been given by ‘You’.

1. CONTRACT AND INCORPORATION OF TERMS
1.1 These Terms and Conditions shall be applicable to all Vouchers and unless set out in these terms, or the context otherwise requires, all references in these Terms and Conditions are to Gift Vouchers Terms and Conditions.
1.2 Purchase and/or use of a Voucher will constitute acceptance of these Terms and Conditions. Please read these Terms and Conditions carefully before using and/or purchasing your Voucher.
1.3 For Vouchers purchased with a Cardology Product, additional Terms and Conditions apply at paragraph 12.
1.4 Tickets purchased using the Voucher are subject to our Terms and Conditions for the Sale of Entertainment Tickets found here.
2.1 Vouchers shall be dispatched by email to the designated email account as soon as payment for the Voucher has been cleared.
2.2 It is your responsibility to ensure that you provide the correct email address. We will not be responsible for the incorrect delivery of Vouchers due to an error by you (such as, a misspoken or mistyped email address).
2.3 Cleared payment is required prior to the dispatch of orders. Payment is taken automatically at the time of purchase. We reserve the right to decline any order without providing explanation.
2.4 Vouchers are only available for purchase in pounds sterling.
2.5 We will not be responsible for emailed Vouchers that cannot be delivered due to the recipient's spam filters, firewalls, capacity of the mailbox, or any other factors outside of Our reasonable control.
2.6 The purchaser of the Voucher has the right to cancel the Voucher within 14 days of receipt provided that the Voucher has not been used. This does not apply to purchases in person, such as at a Box Office, where all sales are final. If You exercise your right to cancel, We will endeavour to refund the amount of the Voucher to the original payment method used during ordering within 14 days of cancellation.
2.7 The purchaser of the Voucher must inform Us of their intention to cancel the purchase within 14 days of the date on which the Voucher is received, we recommend that this is done by submitting a request online at help.atgtickets.com or telephoning our Customer Care team on 03330 096 690*. Please include a clear statement of the wish to cancel the purchase, provide evidence of proof of purchase, details of name, phone number, email address, address, and details of the order to cancel.
3.1 You may use Your Voucher to purchase eligible items at all participating venues in the UK. Vouchers cannot be used at the Nova Cinema in Woking. Vouchers cannot be redeemed against merchandise, food, or beverage purchases in venues. When you use Your Voucher the amount of Your purchase will be deducted from the balance on the Voucher. The remaining balance may be redeemed against future purchases provided that the Voucher has not expired. Change will not be given. If your purchase exceeds the balance on the Voucher, you must pay the excess by another payment method.
3.2 You may check the balance on your Voucher by submitting a request online at help.atgtickets.com or telephoning our Customer Care team on 03330 096 690*. Vouchers cannot be used to purchase Vouchers. You may not exchange or redeem your Voucher for cash.
3.3 We reserve the right to refuse to accept damaged Vouchers or any Voucher which we believe has been stolen, duplicated, tampered with or is being used fraudulently or is otherwise suspected to be affected by fraud.
3.4 One or more Vouchers can be redeemed against a single order.
4. EXPIRATION AND CANCELLATION
4.1 Your Voucher and the balance on it will expire after 12 months from the date of purchase. Once expired, any unused balance will not be refunded.
4.2 We reserve the right to cancel Your Voucher if we suspect it has been stolen, is being used fraudulently or in breach of these Terms and Conditions.
4.3 Except as stated in clause 2 above Vouchers are non-refundable.
5.1 You should take care of Your Voucher and treat it like cash. We will not be responsible for lost or stolen Vouchers.
6.1 The re-sale of Vouchers is strictly prohibited; You may not sell Your Voucher.
6.2 You may only use Your Voucher for Your own personal non-commercial use. Vouchers may not be used in sales or promotional activities including as giveaways or prizes in competitions without our prior written consent.
6.3 We reserve the right to cancel any Vouchers that we suspect have been resold or obtained in connection with an unauthorised sales or promotional activity.
7. DATA PROTECTION AND PRIVACY
7.1 You may be asked to provide certain personal information, including Your or the Recipient’s name, address and contact details. You agree that the information you provide to us will be true, accurate, current and complete in all respects. You also agree to notify us of any changes in this information. We are committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act. All personal information you provide to us will be used in accordance with our Privacy Policy.
8.1 We shall not be liable for any loss or damage arising from or in connection with Your use of a Voucher where such loss or damage arises from any cause beyond Our reasonable control. If We fail to comply with these Terms and Conditions for a reason within our reasonable control, We are responsible for loss or damage You suffer that is a foreseeable result of our breach or Our negligence, but We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of Our breach or if it was contemplated by You and Us at the time we entered into these Terms and Conditions. Where any loss or damage arises from a cause within Our control, Our liability to you shall not exceed a sum equal to the balance on Your Voucher as at the date that such loss or damage occurs. This clause shall not exclude or limit any liability that cannot be excluded or limited by law.
9.1 We reserve the right to amend or waive any provision of these Terms and Conditions from time to time or to terminate the Voucher service on reasonable notice.
9.2 The Terms and Conditions applicable to the use of a Voucher shall at any time be the terms and conditions published on the Site and your continued use of a Voucher shall constitute your acceptance of such terms and conditions.
10.1 These Terms and Conditions constitute the entire agreement and understanding between Us and You with respect to Your use of Vouchers.
10.2 If any provision of these Terms and Conditions is unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
10.3 Any failure or delay by Us in enforcing (in whole or in part) any provision of these Terms and Conditions will not be interpreted as a waiver of our rights or remedies.
11.1 These Terms and Conditions shall be governed by and construed in all respects in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
12.1 If you have any questions, comments or complaints about these Terms and Conditions or your Voucher, please contact our Customer Service by submitting a request online at help.atgtickets.com or telephoning our Customer Care team on 03330 096 690*. We will acknowledge all customer correspondence within 24 hours.
13. ADDITIONAL TERMS AND CONDITIONS WHICH APPLY TO VOUCHERS PURCHASED WITH A CARDOLOGY PRODUCT
Sales of a Cardology Product are fulfilled by our third party partner Cardology.
13.1 Delivery of Your pop-up card will be made by Royal Mail 48 hour tracked postage. Your card(s) will be dispatched by Cardology within 2 Working Days of receiving your order. In order to fulfil Your order, limited details of Your order (your name, delivery address, email address and phone number) will be shared with Cardology and Royal Mail.
13.2 We want you to love Your purchase. If you have any issues with Your order please get in touch at info@cardology.co.uk for pop-up cards or delivery queries, or for ATG gift voucher queries, submitting a request online at help.atgtickets.com.
13.3 Delivery for orders of pop-up gift cards cannot be cancelled due to the speed at which the card is dispatched by post.
13.4 For Cardology Products which are not bespoke, the purchaser has the right to cancel the order for the Cardology Product within 14 days of receipt provided that the product has not been used. This does not apply to purchases in person, such as at a Box Office or bespoke items where all sales are final.
13.5 To obtain a refund You must return the product(s) to Cardology in the same condition in which You received them, including the packing slip. Personalised or used cards cannot be refunded. If you don’t have the packing slip, please include your order number in any correspondence. Please contact info@cardology.co.uk for the returns address.
13.6 You are responsible for arranging return postage and We recommend You get proof of posting or use a trackable service to do so.
13.7 Cardology will examine the returned product(s) and if applicable, will notify you of your refund via e-mail within a reasonable period of time. If the product has been returned due to a defect, we will either exchange or fully refund the item/s in question, within 14 days of the day we confirmed to You via e-mail that you were entitled to a refund for the defective product. Products returned by You because of a defect will be refunded in full, including a refund of delivery charges for sending the item to you, and Your return postage cost. Refunds will be made via the original payment method for your order.
13.8 If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify You as soon as possible. We will contact You to confirm that You are happy to proceed with the order and agree to wait for the original product(s) or would like to select an alternative product or get a refund for your order.
*Calls are charged at standard geographic rates and count towards any inclusive minutes in the same way as calls to 01 and 02 numbers.
