Drinks and Snacks Ordering: Terms of Purchase

1. Introduction
These Drinks and Snacks Ordering: Terms of Purchase (the "Terms of Purchase") govern the sale of drinks and snacks by us, ATG Entertainment Limited, to you, the customer, via our website www.atgtickets.com (the "Site"). The Terms of Purchase, the Terms and Conditions of the Sale of Tickets, the Additional COVID19 Terms and Conditions together with the Terms of Use and Privacy Policy (together the "Terms and Conditions") form the entire agreement between us.
Copies of these Terms of Purchase are available on request. Please read them carefully before placing your order and print a copy for future reference.
2. Information about us
Who we are. www.atgtickets.co.uk is operated by ATG Entertainment Limited, a company registered in England and Wales under company number 2671052 and with our registered office at 2nd Floor, Alexander House, Church Path, Woking, Surrey GU21 6EJ. Our VAT number is 689278071 ("we", " us", "our" or "ATG").
3. About these Terms of Purchase
In these Terms of Purchase:
“Event” means the event at the relevant venue which you are attending;
"Goods" means the drinks, snacks and other food and beverage products listed for sale by us on the Site;
"Order" means an offer to purchase Goods made through our Site;
“Tickets” means your tickets for the Event;
"you" and "your" means the person using the Site to make and pay for Orders relating to the Goods.
4. Placing an Order
How to place your Order. Once you have selected the Goods you wish to order from the menu on the Site, you will be given the opportunity to submit your Order by clicking or selecting the "proceed", "place my order" or similar button. Please check all the information that you enter and correct any errors before clicking or selecting this button as once your Order has been placed, it cannot be changed.
How we will accept your order. When you make an Order, this is an offer by you to purchase the Goods from us. Our acceptance of your Order will take place when we email you to accept it, at which point a contract will come into existence between us.
If we cannot accept your order. If we are unable to accept your Order, we will inform you of this and will not charge you for the Goods.
5. Our Goods and prices
Goods may vary slightly from their pictures. The images of the Goods on our Site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your Goods may vary slightly from those images.
Prices. Goods are displayed with prices in GBP at the time of your order. Prices displayed on the Site include Value Added Tax which will be applied at the current rate where applicable. Prices may be subject to variation without notice. If there is a pricing error on our part, we will contact you as soon as possible. You will have the option of reconfirming your Order at the revised price or cancelling your Order and receiving a refund. If we are unable to reach you, your Order for the incorrectly priced item will be cancelled and we will provide you with a refund.
6. Order processing and order fulfilment
Processing your Order. If the Order is accepted:
- you will receive a confirmation email notifying you that your Order has been accepted which will include a unique reference number;
- your payment method will be authorised and debited in the amount of the Order;
- the venue will prepare the Order and deliver it to the seat numberor click and collect location specified by you when placing your Order.
We accept payment by Visa, MasterCard, American Express and PayPal.
Fulfilling your Order. We cannot guarantee that all Goods ordered online will be available on the day of the Event. We will however do our best to ensure that your order can be fulfilled. In the event that we cannot fulfil your Order or can only fulfil part of your Order, we will provide you with a refund in respect of those parts of the Order which could not be fulfilled.
7. Alcohol Sales
Sale of alcohol. Sales of alcohol are made subject to the Licensing Act 2003 for theatres in England and Wales, the Licensing (Scotland) Act 2005 for theatres in Scotland and any theatre specific conditions stipulated on the premises license. Sales of alcohol may only be made to persons aged 18 or over. By placing an Order for an alcoholic product, you confirm that you are aged 18 or over. In relation to your Order, you must, upon collection/delivery of the alcoholic product at the relevant venue, provide proof of your identity and that you are aged 18 or over in order for the sale to be completed.
Right of refusal. We reserve the right to refuse to deliver any alcoholic products at any point, including where you appear to be under the influence of alcohol or drugs. Where the sale of alcohol is refused by us at the point of delivery, you will be provided with a refund for the relevant part of your Order which was refused.
Confirmations. You further confirm that you are buying any alcoholic drinks for your own consumption or for the consumption of others who are over the age of 18 years of age, not intoxicated or drunk or under the influence of drugs and are legally permitted to consume them.
Please note that all alcohol must be consumed on the premises.
8. Changes, Cancellations and Refunds
Changes to your Order. You accept and agree that once the contract is formed in accordance with clause 4 above, you will not be able to change or cancel the Order and you will not be entitled to a refund for the Order or any part thereof, including in the event that we exercise our right to refuse to fulfil the Order pursuant to these Terms of Purchase, except as set out in these Terms of Purchase.
Refund rights. You have a legal right to receive Goods which comply with their description and which are of satisfactory quality. If you believe that the Goods you have been delivered do not comply with these legal rights, please let us know. We may request a photograph showing the problem if it is something that can be seen by inspecting the Goods and, if the Goods do not comply with these legal rights, we will provide a refund in respect of the affected part of the Order. Please note that statutory cancellation rights do not apply to the sale of the Goods on our Site.
Event related refunds. If you are unable to attend the Event through no fault of ours, you will not be entitled to cancel your Order and receive a refund for your Order. In the event that you have exchanged your Tickets, please contact us to transfer your Order to the new Event.
Event related refunds. Where an Event is cancelled or rescheduled by us or the relevant promoter, where an Event is cancelled or rescheduled due to circumstances beyond our control, or where there is a material change to the programme of the Event, and you have requested a refund of your tickets for the Event, you may also request a refund of your Order.
Refunds general. Refunds shall only be made to you and, when possible, be made using the same method as was used to purchase the Goods. Please note that if you have purchased Ticket Protection, your refund for Tickets under that policy will not include a refund for your drinks and snacks Order
9. Our liability to you
Please refer to clause 8 of our Terms and Conditions of the Sale of Tickets.
Events beyond our reasonable control. For the purposes of these Terms of Purchase, ‘Force Majeure’ means any cause beyond our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to you for failure to perform any obligation under these Terms of Purchase to the extent that the failure is caused by Force Majeure.

11. Other important terms
Waiver. If we delay or fail to enforce any of these Terms of Purchase It shall not mean that we have waived our right to do so.
Assignment. We shall be entitled to assign any of our rights and obligations under these Terms of Purchase provided that your rights are not adversely affected.
Severability. If it is found by a Court that any of these Terms of Purchase for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
Third Parties. Any person who is not a party to these Terms of Purchase shall have no rights under the Contracts (Rights of Third Parties) Act 1999 (the Act) to rely on any of these Terms of Purchase.
Amendments and Variations. We intend to rely on the written terms set out here in these Terms of Purchase. You should read the Terms of Purchase carefully before entering into the contract to ensure that they contain very thing that you consider has been agreed. If they do not then you should speak to any member of staff. After the contract has been made, these Terms of Purchase cannot be varied or amended in any respect unless both you and we agree and it is preferable that this is in writing.
No partnership of agency. Nothing in these Terms of Purchase and no action taken by you or us under these Terms of Purchase shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms of Purchase.
Entire agreement. These Terms and Conditions constitute the entire agreement between us in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between us. Each of us agrees that we have not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms and Conditions or not) other than as expressly communicated by us to you before you have completed your purchase or set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.
Governing law and jurisdiction. These Terms of Purchase shall be governed by and construed in all respects in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

We aim to acknowledge all customer correspondence within 24 hours.
13. Dispute Resolution
If any dispute arises out of these Terms of Purchase, we will attempt to settle it. We will aim to acknowledge all customer correspondence within 24 hours and we shall use our reasonable endeavours to consult or negotiate in good faith, and attempt to reach a just and equitable settlement satisfactory to both parties within 5 working days. Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 21 days and you are not satisfied with our final response, you may attempt to settle it through Alternative Dispute Resolution and can contact The Society of Ticket Agents and Retailers (STAR). We are members of STAR and they provide a free and approved dispute resolution service for customers of STAR members.
